Terms of Use
Please read these Terms carefully. They include important limits on our responsibility, a refund policy for customized digital manuals, and the license that governs how you may use your manual.
Agreement to These Terms
These Terms of Use are an agreement between you and Aesthetic Nursing Policy & Procedures, Inc. ("Aesthetic Nursing P&P," "we," "us"). They apply when you use aestheticnursingpnp.com, the Binder Blueprint, the Findings Brief, or the Manual Builder at theaestheticmanual.com (together, the "Sites"), including when you buy a manual. By using the Sites or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Sites.
Consulting engagements, CE courses and other services may be covered by a separate agreement or terms. Where they differ, the separate agreement controls for that service.
Education and Consulting, Not Legal or Medical Advice
We provide nurse-led compliance consulting, education and document templates. We are not a law firm, and nothing on the Sites or in our documents is legal advice or medical advice, or creates an attorney-client relationship. Laws, regulations and Board positions vary by state and change over time. Before relying on any information or document, review it with your medical director and a licensed attorney in your state.
Information about Board actions, including the Accusation Review and Findings Brief, comes from public records and is offered for education. Our documents have been submitted to and accepted by State Boards in past matters, but every case is different. We do not guarantee any outcome with any Board, agency, insurer or court.
Who May Use the Sites
The Sites are intended for licensed healthcare professionals, practice owners and their staff in the United States. You must be at least 18 and able to enter into a binding agreement. If you use the Sites for a practice or company, you confirm you are authorized to accept these Terms on its behalf.
The Manual Builder
What You Receive
The Manual Builder creates an editable Microsoft Word manual, an Aesthetic Medical & Wellness Policies & Procedures template, using the practice details, state, treatment menu, cover and logo you provide. State content summarizes public Board and agency sources as of the research date shown in the builder.
Your Responsibilities
- Provide accurate information. Your manual is built from exactly what you enter.
- Have your manual reviewed, adapted and approved by your medical director, and by an attorney where appropriate, before putting it into use.
- Confirm the content against current state law, your scope of practice, your supervision and delegation arrangements, and your actual procedures.
- Keep the manual current. You are responsible for how your practice uses and implements it.
Your Logo and Content
You confirm that you have the right to use the logo, names and other details you submit. You allow us to use them only to build, store and deliver your manual.
Access Codes and Passwords
Access codes are provided to prepaid clients for their own practice. Please don't share them. We may change or turn off a code at any time.
License to Use Your Manual
The manuals, templates, Findings Brief, Binder Blueprint and all other content on the Sites are owned by Aesthetic Nursing P&P and protected by copyright. When you buy a manual, we grant you a non-exclusive, non-transferable license to use, copy, edit and print it for the internal operations of the one practice named in your order, including its locations under the same ownership.
You may not:
- Sell, resell, share, publish or distribute the manual or any template, in whole or in part, to anyone outside your practice.
- Use it for another practice or client, or to create a competing template, course or product.
- Remove copyright notices or serial numbers.
Consultants and management companies need a separate license for each client practice.
Prices, Payment and Delivery
Prices are shown before checkout and are charged in U.S. dollars through Stripe. You agree to provide current, complete payment information and to pay any applicable taxes. We may change prices at any time; changes don't affect orders already paid.
After payment, your manual appears on a download page and a download link is emailed to you. Links work for 30 days. If you need a new link, contact us with your serial number.
Refunds
Because each manual is customized and delivered digitally, all sales are final once your manual has been delivered. If your file won't open, is incomplete, or was built with an error on our side, contact us within 14 days of purchase and we will correct it or, if we cannot, refund your payment. Errors in the information you entered can be fixed by building a new manual.
Acceptable Use
Please don't:
- Upload patient information, unlawful content or files you don't have the right to use.
- Try to access the master template, other users' orders, administrative areas or systems you aren't authorized to use.
- Copy, collect or download content from the Sites by automated means, or interfere with how the Sites work.
- Use the Sites to violate any law or anyone's rights.
We may suspend access or cancel an order that violates these Terms.
Third-Party Services
The Sites rely on outside services such as Stripe, Zoom, EmailJS, Google, Render, GitHub and Cloudflare. Their terms govern your use of them, and we are not responsible for their services. Links to other websites are provided for convenience.
Disclaimers
The Sites and all content, templates and manuals are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness and non-infringement. We do not warrant that the content reflects every current law or Board position in your state, or that the Sites will be uninterrupted or error-free.
Limitation of Liability
To the fullest extent the law allows, Aesthetic Nursing P&P and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, or for fines, penalties or Board, licensing or disciplinary actions, arising from your use of the Sites or any content, template or manual. Our total liability for any claim relating to the Sites or a purchase will not exceed the amount you paid us for the product giving rise to the claim in the 12 months before the claim, or $100 if you paid nothing.
Indemnity
You agree to defend and hold harmless Aesthetic Nursing P&P from claims, losses and expenses, including reasonable attorneys' fees, arising from your use of the Sites or any manual, the information or files you submit, or your violation of these Terms or the law.
Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it informally. Any dispute that can't be resolved informally will be brought only in the state or federal courts located in San Diego County, California, and you and we consent to their jurisdiction.
Changes and General Terms
We may update these Terms. The version posted here, with its effective date, applies from that date forward; the version in effect when you placed an order applies to that order. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any separate service agreement, are the entire agreement between you and us about the Sites.
